TERMS AND CONDITIONS OF SERVICES OF “THE EYE HAS TO TRAVEL”

The following terms and conditions apply to both natural and legal persons who seek to rent a vehicle – motorhome (hereinafter referred to as “the Renters”) from the sole proprietorship under the name Chariklis Aristidis of Emmanouil, GEMI No. 182987909000 and VAT No. 146836832, headquartered at 13 Poseidonos, Glyfada, 16674 (hereinafter referred to as “the Business”). The parties agree that by registering on the platform, they accept the relevant terms prior to payment, and the entirety of these terms upon payment.

The Business, for the purpose of providing vehicle rental booking services (Activity Code 79111400), recommends and encourages a thorough reading of the following terms to ensure that the Renters (hereinafter together with the Business referred to as “the Parties”) understand their rights and obligations when conducting transactions via the provided website (“Platform”).

1. A) THE BUSINESS The Business lists on the Platform the vehicles available for rent, detailing their features (seats, beds, fuel type, transmission type, age limit for use, required driver’s license type, etc.), delivery and return address, characteristics related to their use as motorhomes and accommodation provisions (e.g., cruise control, parking camera, kitchen equipment, fridge, toilet, TV antenna), price and availability (which may vary based on bookings), and optional extras (e.g., airport transfer, BBQ system, baby seat). The Business guarantees the truth and accuracy of the listed information. This act constitutes an invitation to make an offer (invitatio ad offerendum).
2. The Business guarantees and ensures that the listed vehicle:
3. Complies with all safety regulations as per Greek Law and is maintained according to the manufacturer’s recommendations.
4. Undergoes regular technical inspections as mandated by Greek Law and carries a valid Technical Inspection Certificate (KTEO) or equivalent documentation ensuring safe operation and reduced emissions, valid for the rental period.
5. Possesses a valid Vehicle Registration issued by Greek authorities and displays a legal license plate.
6. Holds valid insurance coverage including Third-Party Liability for bodily injury per victim, property damage per incident, Personal Accident for Driver, and damage caused by uninsured vehicles.
7. Has all necessary fluids in appropriate quantities, and is free of damage or faults that would jeopardize safe operation.
8. These conditions apply at the time of listing and throughout the vehicle’s presence on the Platform. If these are no longer met, the Business will promptly remove the vehicle and cancel any existing rentals.

• By listing a vehicle on the Platform, the Lessor confirms the accuracy of the description and that the vehicle’s condition corresponds to the information provided.

1. B) TERMS FOR RENTERS To rent a listed vehicle, the prospective Renter must create an account on the Platform by registering a username, password, email, and phone number. The Renter is solely responsible for the confidentiality and accuracy of this information. Once registered, the Renter may browse available vehicles, check availability for desired dates, select optional extras, and receive an automatic rental cost calculation including a mandatory cleaning fee. A Security Deposit must be paid on the day of vehicle collection following an inspection. The Renter will then send a rental request, which constitutes a contract offer.

For legal entities, registration must be done through a legal representative. The Security Deposit covers potential damage or loss and is refundable upon safe return of the vehicle.

Renters must not share login credentials or allow third-party access. The Business may access accounts only for troubleshooting and with consent or necessity.

2. Hold a valid Driver’s License for at least 3 years and a Greek ID card.
3. Be over 25 years old.
4. Have no criminal convictions for theft, fraud, extortion, bribery, dangerous driving, or driving under the influence.
5. Not be under legal guardianship.
6. Not be excluded by insurance companies due to reckless driving.
7. • Renters must confirm compliance with these criteria. The Business may verify documents and deny or cancel registration without liability. These requirements apply to anyone who drives the vehicle.

• Requirements must remain valid throughout Platform use. Non-compliance mandates cancellation of requests and existing rentals, and the Renter bears full liability for any damages.
• Submitting a rental request confirms a genuine intent to contract under the stated terms.

1. C) TERMS FOR THE PARTIES
2. Upon a rental request, the Business has 24 hours to accept; silence constitutes rejection. If accepted, the Renter must pay the total cost (rental fee, cleaning fee, extras) within 24 hours using accepted payment methods. Accurate personal data must be provided for contract purposes. The Business may verify data and reject the contract. Completion of payment finalizes a binding Rental Agreement, including these Terms and Conditions.
3. The Delivery and Return Forms, completed upon vehicle handover and return, become integral parts of the Rental Agreement.

• • The Business must deliver the vehicle as specified and complete the Delivery Form accurately.
• The Business may refuse delivery if:
• Identity or license cannot be verified.
• The vehicle or driver fails legal requirements.
• Deposit is unpaid.
• There are safety or operational concerns.
• Renter fails to appear within 24 hours of the scheduled handover.

In such cases, the Business may terminate the agreement and claim damages.

1. • The Renter must obey Greek laws, the Road Code, manufacturer guidelines, the Rental Agreement, and these Terms. Only authorized drivers may operate the vehicle. Delivery and Return Forms must be signed, noting vehicle condition.

• Renters must:
• Pay the deposit.
• Use the vehicle responsibly.
• Monitor its mechanical status.
• Keep it clean and notify the Business of any issues.
• Avoid modifications, subleases, or unauthorized use.
• Perform necessary repairs due to fault or emergency.
• Renters are liable if they:

1. Fail to collect the vehicle without valid cause.
2. Fail to use the vehicle as intended.

• Renters must not:
• Use substances that impair driving.
• Be under medication that impairs driving.

This also applies to any additional drivers.

• The Renter is responsible for all taxes, fees, duties, and fines related to the vehicle during use.
• The Renter may refuse the vehicle if:

1. It fails to meet required standards.
2. It doesn’t match the listed description.
3. The Delivery Form isn’t signed by the Business.
4. Damage isn’t properly recorded.

In such cases, the Renter may terminate the contract and claim a refund and damages.

• Upon return, the vehicle must be in the same condition, with keys, documents, fuel, and personal items removed. The Business is not liable for any personal belongings left behind.
• The Rental Agreement remains valid for its duration unless canceled under the Cancellation Policy. Early return does not constitute termination. In case of fault by the Business causing a breakdown, the Renter is entitled to compensation for lost rental days.
• The Business reserves the right to update these Terms at its discretion. Renters can view the latest version on the Platform. Continued use implies acceptance.

1. D) PAYMENT POLICY 1) The Renter must pay the rental fee within 24 hours of acceptance. This upfront payment (excluding the deposit) finalizes the contract. If the contract is accepted within 24 hours of rental start, payment must be immediate.

• The Renter agrees to pay a deposit upon vehicle collection following inspection.
• Payments must be made to the National Bank of Greece, IBAN: GR7201101710000017100950959. Proof of payment must be documented. Legal tax receipts will be issued. The agreed rent is considered fair and binding.

1. E) CANCELLATION POLICY The Business may cancel listings or reject requests before acceptance. Renters may withdraw requests before acceptance. The agreed Cancellation Policy is:

Preparation costs are non-refundable.

1. F) PENALTIES FOR MISUSE Smoking in vehicle: €200 2. Pets in vehicle: €200 3. Exceeding travel limits: €300 + damages 4. Exceeding occupancy: €300/day per extra person 5. Empty fuel tank: €140 6. Full chemical toilet: €100
2. G) MISCELLANEOUS 1) Data entered on the Platform is stored in the Business’s database and processed per the Privacy & Cookies Policies.

• The Business does not guarantee uninterrupted Platform availability. Issues may arise (e.g., connectivity, viruses). The Business may suspend operation without liability.
• Renters may delete their accounts, but remain liable for existing rentals. The Business may also delete accounts for violations.
• Breach of any term entitles the non-breaching party to terminate the contract and seek damages.
• This agreement may only be amended in writing. Greek law applies. Disputes shall be settled by Athens courts. Service of legal documents is valid at the address provided on the Platform.
